1. Acceptance
By using CruiseGem, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use the service. You must be able to form a binding agreement where you live.
2. What CruiseGem provides
CruiseGem is an independent cruise search and price-intelligence service. We collect and organize sailing information, displayed fares, availability signals, price history, itinerary details, and deal analysis. CruiseGem is not a cruise line, ship operator, excursion operator, payment processor, or the merchant completing your reservation.
3. Prices, availability, and Gem Ratings
Cruise prices can change at any time. A displayed amount may be per person or per cabin and may use a stated occupancy, residency, currency, cabin category, promotion, or fee assumption. Taxes, port charges, gratuities, deposits, airfare, transfers, and extras may be included or excluded as described on the page.
Price history and Gem Ratings are decision aids based on information CruiseGem successfully captured. They are not price guarantees, financial advice, or predictions. Always verify the live total, passenger eligibility, cabin assignment, cancellation terms, and availability with the booking provider before paying.
4. Third-party bookings and links
When you follow a link to a cruise line, excursion marketplace, travel seller, webcam, map, or other service, you leave CruiseGem. Your booking, payment, refund, travel contract, and dispute are with that third party and governed by its terms. CruiseGem is not responsible for a third party’s content, availability, fulfillment, schedule changes, cancellations, or handling of personal information.
5. Affiliate relationships
CruiseGem may receive a commission when you follow certain links and complete a purchase, at no extra cost to you. CruiseGem’s published price history and Gem Rating are based on fare and availability data, not the commission a partner may pay.
6. Alerts and communications
You may request price, availability, saved-search, or deal emails. Delivery can be delayed or fail, and a fare may change before you read an alert. You are responsible for monitoring any booking deadline that matters to you. You can manage preferences or unsubscribe through the links in our emails.
7. Personal, noncommercial license and restricted industry access
Subject to these terms, CruiseGem grants you a limited, revocable, nonexclusive, nontransferable license to access and use the service solely for your own personal, noncommercial cruise research and travel planning. No other rights are granted. Any business, professional, revenue-generating, competitive, resale, publication, research-dataset, or other commercial use requires CruiseGem’s prior written permission or a separate written license.
Access to or use of CruiseGem by or on behalf of a cruise line, cruise operator, related company, employee, contractor, designee, representative, agent, travel agency, travel advisor, online travel agency, industry data provider, or other cruise-industry business is prohibited unless CruiseGem has provided prior written permission. This restriction applies whether the access is for commercial, competitive, operational, investigative, monitoring, data-collection, or other business purposes. Permission granted in a written agreement controls to the extent it conflicts with this restriction.
8. Scraping, automation, and data-use restrictions
Except for public search engines acting in accordance with our robots.txt instructions, you may not use a robot, scraper, spider, crawler, browser automation tool, script, data-mining process, or other automated means to access, query, copy, monitor, download, index, or extract CruiseGem or its data without our prior written permission. This restriction applies even when the information is visible without signing in.
You also may not:
- bulk download, systematically collect, cache, mirror, frame, or reproduce CruiseGem content or search results;
- resell, sublicense, publish, syndicate, distribute, display, or commercially exploit our compiled sailing, pricing, availability, price-history, Gem Rating, deal, itinerary, excursion, or ship data;
- use CruiseGem content to build, enrich, validate, benchmark, or operate a competing product, price database, commercial lead list, machine-learning dataset, or model-training corpus;
- circumvent rate limits, access controls, robot exclusions, technical safeguards, or measures intended to prevent automated access;
- reverse engineer nonpublic APIs, impersonate another user, conceal automated traffic, or place an unreasonable load on the service; or
- remove ownership notices, misrepresent the source or freshness of data, or suggest that CruiseGem endorses another service.
Normal browser caching, downloading a personal export offered by CruiseGem, and sharing an ordinary link for noncommercial purposes are permitted. A written data license may grant broader rights; if it conflicts with this section, that signed agreement controls.
9. Other acceptable-use rules
You may not interfere with the service, probe or bypass security controls, submit harmful code, misuse another person’s information, violate applicable law, or use CruiseGem to infringe another person’s rights. We may block, rate-limit, suspend, or terminate access associated with suspected misuse and preserve relevant records when reasonably necessary to protect the service or enforce these terms.
10. Intellectual property and data rights
CruiseGem’s branding, original writing, software, page design, selection and arrangement of data, compiled price history, charts, Gem Ratings, and deal analysis are protected by applicable intellectual-property, contract, and other law. These terms do not claim ownership of unprotectable facts or third-party materials. Cruise-line names, ship names, destination marks, photographs, and other third-party content belong to their respective owners. Reference to them does not imply ownership or endorsement. 11. Service changes and disclaimers
We may correct data, change features, limit access, or suspend the service when reasonably necessary. CruiseGem is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in these terms excludes rights that cannot legally be excluded.
12. Limitation of liability
To the fullest extent permitted by law, CruiseGem will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost savings, lost data, missed fares, supplier changes, or travel disruption arising from use of the service. CruiseGem’s aggregate liability for a claim will not exceed the greater of the amount you paid CruiseGem for the service during the prior 12 months or $100. Some jurisdictions do not allow certain limitations, so part of this section may not apply to you.
13. Governing law
These terms are governed by Florida law, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Any proceeding not eligible for small-claims court will be brought in a state or federal court with jurisdiction in Pasco County, Florida, and each party consents to that venue.
14. Changes and contact
We may update these terms as CruiseGem changes. The effective date identifies the current version. Continuing to use the service after an update means the revised terms apply to future use. Questions and requests for commercial data licensing may be sent to [email protected].
